joesteph
I thought this would go better under General Chat, since it's not exactly what I'd call the art of the sword.http://www.cnn.com/2009/CRIME/09/15/samurai.sword.killing/index.htmlAny burglar who isn't crazed (as in "on something") would have bolted right then and there. I believe the defender when he said he was lunged at. ~ JoeVee Arnis Jitsu/JuJitsu

joesteph
Here's a video update about the situation from MSNBC. If you watch just part of the video, it seems that it's about the samurai sword, but if you follow it all the way through, it becomes irrelevant, even stating that it isn't illegal to own one, and focuses on the burglar and lunging at the college student holding the sword.http://today.msnbc.msn.com/id/26184891/vp/32950225#32950225 ~ JoeVee Arnis Jitsu/JuJitsu
DWx
There was a similar case over here where a guy shot an intruder with a shotgun and killed him. He was acquitted but it raised debates on how much you can do to protect your own home from intruders. I think there was also another case with a rifle but I can't remember... The question seems to be more about trying to prove that the sword strike was made in self-defense, from my understanding of the articles. I would imagine if no one can say that the student did not act in self defense then the student will not be charged. Also, there is no "retreat clause" in MD law when defending one's person or property. Mistassailant5
I would think that would be legal because in New York if someone is in your house and they try to attack you, you do have the right to kill them. I am not a fighter, I am a guardian.
