Depends on the state. For the most part, the law enforcement folks will generally frown upon you, if you are carrying a baton.

There are some states that have concealed weapons permits that extend to both firearms as well as hand-held weapons, such as Kentucky, while others, such as Connecticut, actually have a concealed weapons permit for what they call "deadly weapons" that is a separate entity from the concealed handgun permit.

Then, there are some states that will offer concealed handgun permits, but will not allow you to carry a baton.

In some states, such as California, carrying a baton is a felony, and the same surprisingly holds true in Texas.

When it comes down to it, contact your local law enforcement agency, and ask if it's possible to carry around an ASP baton or nightstick, and what needs to be done to get the proper permit. Don't be surprised, though, if they tell you that you can't.

Just as a bit of humor, regarding the Kentucky concealed weapons permit:

What weapons are covered under the CCDW permit?

Any weapon from which a shot, readily capable of producing death or serious physical injury, may be discharged.

Any knife other than an ordinary pocket knife or hunting knife.

Billy, nightstick, or club.

Blackjack or slapjack.

Nunchaku karate sticks.

Shiriken or death star.

Artificial knuckles made from plastic, or other similar hard material

Now where can I find a planet-killing laser? :)

On another note, have you ever thought about carrying a 4 or 5 D-cell Mag Lite? Those are just as good as any nightstick, and last I saw, most places don't have laws against carrying flashlights.

Check with your local law enforcement agency about restrictions and laws in your state.

In Canada you can be charged with carrying a concealed weapon if you are caught carrying an asp baton.

You'd be better off carrying a combative cane. No one will arrest or fine you for it, and it can be extremely effective in a combat situation if you know how to use one.

The cane and the flashlight are very good ideas and great ways to take full advantage of every day objects. IF you think about it, the laws only govern those weapons that actually 'appear' to be weapons. For example, I can't carry a four inch kubotan on my keychain due to it's illegality, but I can walk about with a three foot tree brach if I wanted to. Now, somebody who would be looking for ways to commit malicious acts may just consider how much easier it is to land a deadly blow with a tree brand than with some brass knucks.

When I go for a walk at night, I carry a variety of everyday 'weapons' with me. One is a two foot long nylon shock cord ran through and old keychain with some old keys on it. Make one for yourself and take some swipes at a tree and watch the tree disintigrate. It takes awhile to familiarize yourself with a weapon like this, but it is well worth it to work it into your favorite techniques. Another is a three D cell maglite. Like listed above, this can be a very lethal weapon, and much less frowned upon than a cudgel. I also carry a Gerber model 460 combat folder in my front pocket and am quite confident wtih it, god forbid the situation warrant its use.

To answer the original question, around my parts, it isn't illegal to carry a baton, but a police style tonfa is...go figure. Again,, which one looks like it would do worse damage is the one that is illegal.
